This Privacy Policy ("Policy") sets out the manner in which your information collected through any digital lending application we use is collected, used, and disclosed. This Policy applies only to personal information collected through the platform. Please read this Policy carefully. By continuing to use the service, you agree to this Policy. If you do not agree to this Policy, you may choose not to use the service.Access to any platform is subject to the terms and conditions (Terms) accessible on that platform.

1. Introduction

We, WOODSTOCK EXPORTS PRIVATE LIMITED (the Company; we; us; our), operate a digital lending application called Credit Master (the Application/ App) through which you can apply for loans (Loans) granted pursuant to loan agreements signed between you and our lending partners. You (the Customer) authorize us to collect, store, verify, authenticate, and distribute personal information (defined below) that may be required for the processing and approval of the Loan, through a mobile application form (the Mobile Application Form) provided on the Application.

We are committed to protecting your privacy and have developed this Privacy Policy to describe the procedures we follow in collecting, using, and disclosing personal information. We recommend that you read this Privacy Policy carefully to understand how we use your personal information.

2. Collection of Personal Information

To use the service, you are required to register with the Company by logging in through a third-party platform (User Account) in accordance with this Policy. The service refers to the facilitation of loans through the platform.

During the application process, you will be required to share/upload certain personal information:

User Personal Information: The data points we collect from you for loan and non-loan services include your full name, identification proof, address, work information, income information, etc.

Microphone, Location, Camera, Album, Contact Access: We will collect your approximate location and request access to the camera and microphone to allow you to capture and upload information while filling out the loan application, speeding up the process of providing information.

How we use this information: We will collect your device's location information to verify your address, confirm the authenticity of the operation, and prevent identity theft and fraud. We may use the camera, as required by applicable laws and instructions from our loan partners, to scan and capture the necessary KYC documents. We are required to transmit such information to our loan partners and will not store any such data. We require microphone permissions for two-way communication between our authorized agents and you to conduct video KYC for the purpose of executing and completing loan services. Your audio will be recorded for regulatory purposes.

You understand and acknowledge that the Company reserves the right to track your location (tracking) during the provision of the service and until you have an outstanding obligation to pay, through the mobile application or other means, until the service is deleted or uninstalled by you. The deletion, uninstallation, and/or termination of our service do not relieve you of the responsibility and obligation to repay any outstanding amounts.

Furthermore, you understand and acknowledge that the provision of information provided here is voluntary, and you may choose to provide and/or refuse to provide any data. However, if no data is provided, you may not be eligible to access certain services that require the collection of data.

3. Disclosure

We will not sell, rent, or lease your personal information to anyone, and we never will. However, please be aware that we may disclose your personal information in the following circumstances:

Administrators: For internal business purposes, we may provide access to your personal information to our authorized administrators who are bound by confidentiality obligations.

Affiliated Companies: We may share the collected personal information with our affiliated companies, including insurance companies with your explicit consent. For example, we may disclose personal information to our subsidiary companies in order to respond to your requests for information or services or to help limit the marketing materials you receive as per your request.

Business Partners: We may engage trusted third-party companies and individuals to assist us in providing, analyzing, and improving the service, including but not limited to data storage, maintenance services, database management, credit bureaus, rating agencies, web analytics, and payment processing. These third parties will only access your information for the purposes of performing tasks on our behalf and are subject to similar obligations as outlined in this Privacy Policy. We may disclose your personal information to business partners who perform business functions on our behalf or provide hosting services and may be located outside of India. Rest assured that all your data is stored only on servers located in India.

Service Providers: We may share your personal information with service providers who operate the services or platforms on our behalf, provided that such service providers comply with consistent confidentiality and privacy policies.

Joint Marketing Arrangements: Where permitted by law, we may share your personal information with joint marketing partners with whom we have marketing arrangements. We will require all such joint marketing partners to enter into written agreements specifying the appropriate use of your personal information, requiring them to protect your personal information, and prohibiting unauthorized or unlawful use of your personal information.

We may also disclose your personal information to law enforcement officials or others to(a) credit information companies; (b) comply with judicial proceedings, court orders, or legal processes served on us or the platform; (c) enforce or apply this Privacy Policy or the terms of service or our other policies or agreements; (d) involve bankruptcy proceedings affecting all or part of the information's ownership; (e) respond to any allegations of personal information infringement by third parties; (f) or protect the rights, property, or personal safety of the Company or the public. You agree and acknowledge that we may not notify you before or after disclosure under this section.

Despite the above provisions, the Company is not responsible for the actions or inactions of service providers or any other party with whom personal information is shared, and the Company is not responsible and/or liable for any other information you may choose to provide directly to any service provider or any third party.

4. Data Retention and Deletion

Credit Master is committed to protecting your personal data from unauthorized access, misuse, and disclosure by implementing appropriate security measures based on the type of data and the way we process it. We retain information about you to provide a seamless experience, to contact you when necessary for support, to maintain information about your account, and to detect, mitigate, prevent, and investigate fraud or illegal activities during the course of our services. We may retain your data as needed to provide our services to you. We may also retain and use your basic personal information, including your name, contact number, transaction details, and address details, as required to comply with our legal obligations, resolve disputes, and enforce our agreements, which should always be in compliance with applicable laws. Subject to the provisions of this section, we may delete your data upon a reasonable written request at any stage. However, please note that after deletion, you may no longer be able to use our services.

5. Changes to this Privacy Policy

We reserve the right to change, modify, add, or remove portions of this Privacy Policy at any time and for any reason. If there are any changes to the Privacy Policy, we will update it on the platform. Unless otherwise stated, these changes will be effective immediately upon posting. Your continued access or use of the services signifies your acceptance of the changes and revised Privacy Policy.

6. Security

We take the security of your personal information seriously and employ extensive security measures to protect personal information on the platform from loss, misuse, or alteration. To safeguard your personal information, we have implemented sufficient technology and will update these measures as new technology becomes available. All personal information is securely stored in a secure cloud setup, and all communications are conducted through bank-grade secure SSL communication channels. While we provide appropriate firewalls and protections, we cannot guarantee the security of any personal information transmitted as our systems are not hacker-proof. Unauthorized hacking attempts, virus attacks, technical issues may result in data breaches, and we disclaim any responsibility for such events.

You are responsible for all actions taken under your user account. If you choose to share your user account details and password or any personal information with third parties, you do so at your own risk. If you lose control of your user account, you may lose substantial control over your personal information and may be subject to legally binding actions.

7. Your Rights

Modification or Correction of Your Information: If any personal information you provided is inaccurate, incomplete, or outdated, you have the right to provide us with accurate, complete, and up-to-date data and request us to correct such data on our end immediately. We urge you to ensure that you always provide us with accurate and error-free information/data to ensure uninterrupted use of our services. In case of changes to personal information, users will be required to provide supporting documentation related to the changes for verification by the company.

Your Privacy Controls: You have certain choices regarding the information we collect and how it is used:

  • Your device may have controls to determine what information we collect. For example, you can modify permissions on your device to remove any permissions that may have been granted. However, if any such controls are taken, the platform does not provide service guarantees.
  • Uninstalling the application from your device.Withdrawal/Refusal of Consent: You acknowledge that the platform has formally collected information with your consent, and you have the option to choose not to provide such information, refuse consent for the use of specific information, or revoke consent that has been given. However, if any of the services you use are active, withdrawal of such personal information is not permitted. If consent is withdrawn, the platform does not guarantee nor assume responsibility for providing such services. You have the following rights regarding the information we collect from you.
  • Refusal of Consent: You have the right to refuse consent for the use of specific data, restrict disclosure to third parties, retain data, and revoke consent for the collection of personal data and request the application to delete/forget the data as necessary. However, any such refusal does not harm the rights of loan partners to retain any data related to the loans or non-loan service providers to provide non-loan services to you. Additionally, if any such controls are taken, the platform does not provide guarantees and is not responsible for the continued convenience of services.
  • Withdrawal of Consent: You may withdraw your consent at any time to be contacted, continue collection, use, or disclosure of your information by making a request on the platform or by emailing us at cs@woodstockex.com. However, if any such controls are taken, the platform does not provide service guarantees.

8. Limitation of Liability

You expressly understand and agree that the company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, reputation, use, data, information, details, or other intangible losses arising from the following reasons (even if the company has been advised of the possibility of such damages): (i) use or inability to use the services; (ii) unauthorized access or alteration of your personal information.
